Heard.

The allegation of the petitioners in the writ petition is that respondents 2 to 4 are trying to excavate their private lands for creating a tank under Neeru-Meeru Programma in Petlurivaripalem Village, Narasaraopet Mandal, Guntur District, without following due process of law.

Learned Government Pleader for Revenue has received instructions, which state that though there is an administrative sanction granted for Neeru Chettu Programme, the Village Janma Bhumi Committee has not proposed any agency for execution of the work and as such, no work order has been given and no work is going on in the said area as of now. It is stated that as and when requisition is received from the Executing Department, the same would be processed under due process of law while taking up work in the area encroached by the petitioners.

In view of that, nothing further survives for consideration. Accordingly, the writ petition is disposed of directing respondents 2 to 4 to follow due process of law, if any action is intended to be taken against the petitioners.
