THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.No.3307 of 2017 ORDER:

This bail application under Section 438 Cr.P.C. seeking Anticipatory Bail is filed by the petitioner/A1. Against whom and others the SHO, Chinna Chowk U/G PS, Kadapa has registered a case in Cr.No.73 of 2017 for the offences punishable under Section 370 IPC and Sections 3, 4, 5 and 6 of Prevention of Immoral Trafficking Act. 2) Brief facts of the case are that on 18.04.2017 on information, the Inspector of Police, Chinna Chowk PS along with his staff proceeded to Prakashnagar, Kadapa and arrested A3 and on his confessional statement he seized condoms and cell phones. His confessional statement reveals that the petitioner/A1 procured house on rent in Prakashnagar and procured victims from various places and running brothel house in that area and also in different places.

Hence, the charge.

3) Learned counsel for petitioner/A1 would submit that petitioner is a respectable lady and on political grounds false cases were foisted against her.

4) Severely opposing the bail, learned Public Prosecutor (AP) would submit that the petitioner is a habitual offender and previously similar types of cases were registered against her in Cr.No.152/2015 of Kadapa Taluk PS and Cr.No.216 of 2016 of Chinna Chowk Taluk PS and they

are pending and therefore, bail may be refused to her as the investigation is still pending.

5) A perusal of CD file would show that there is a prima facie case against the petitioner/A1 and other accused and the instructions submitted by SI of Police, Chinna Chowk PS, Kadapa would show that similar types of cases were registered against the petitioner, as stated supra by the Public Prosecutor.

6) In view of the gravity of the offence and pending investigation, it is not a fit case to grant anticipatory bail to the petitioner. 7) Accordingly, this petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
