Pennada Gandhi v. Pepakayala Surya Rao
HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.1218 OF 2012 JUDGMENT:
The present Second Appeal is preferred by the plaintiff - appellant having been unsuccessful before the Courts below in getting a decree for payment of compensation on the ground of malicious prosecution in C.C. No.459 of 2005, wherein he was acquitted.
2. Heard Sri T.V.S. Prabhakar Rao, learned counsel for the appellant.
3. The learned counsel for the appellant would fairly submit that this Court by the order dated 15.11.2012 dismissed S.A. No.951 of 2012, where a similar relief was claimed by one Pennada Gandhi, who was also an accused in the very same contempt case on the file of Additional Judicial Magistrate of First Class, Kothapeta, and, thus, the subject matter is squarely covered by the aforesaid judgment. Copy of the said judgment is also placed for perusal.
4. Therefore, the present Second Appeal is dismissed, at the admission stage itself, in terms of the judgment referred to above which shall form part of the record, as no question of law much less substantial question of law arises for consideration. There shall be no order as to costs.
