THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.15846 OF 2010 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction preferably one in the nature of Writ of Mandamus declaring the Memo dated 0810-2009 issued by the respondent No.3 and also inaction on the part of the respondent Nos.1 and 2 to initiate steps for conducting survey and demarcation of the petitioner's land as ordered by the respondent No.1 in CMA.No.63 of 1997 dated 05-09-1997 and also order of the Hon'ble High Court in WP.No.18508 of 2005, dated 06-12-2005 as illegal, arbitrary and violative of principles of natural justice and consequently, direct the respondents 1 & 3 to conduct survey of the petitioner's land situated in Survey No.295/A, at Chaparallapally Village, Mulkapally Mandal of Khammam District and fix boundaries."

When the matter is called, it is informed by the learned counsel for the petitioners that in the year 2016, survey has already been conducted to the subject land and hence, prays this Court to direct the official respondents to proceed further in accordance with the said survey report.

Considering the facts and circumstances of the case and the grievance of the petitioners, without going into the merits of the case, the official respondents are hereby directed to take appropriate further steps basing on the survey already conducted by them.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
