HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No. 386 OF 2015 ORDER:

The present criminal revision is filed against the order dated 11-02-2015 passed in Crl.M.P.No.550 of 2014 in NCB F.No.48/1/2/2014/NCB/SUB-Zone/HYD, wherein an application filed by the petitioner for opening the factory which was run in the name and style of M/s. Guna Sai Life Sciences Private Limited situated at Sy.No.464, 465 of Nagaram Village, Choutuppal mandal.

2. The case of the prosecution is that on 06-07-2014 and 07-072014 the officers of Narcotic Control Bureau (NCB) carried out a comprehensive search of the company and found huge quantity of chemicals and substances in the premises. Since the test on said chemicals could not be done, the officers seized the records and locked the premises.

3. Learned counsel for the petitioner submits that the premises may be opened for running the factory, as there is every likelihood of machinery getting damaged if the same is not put to use. He further submits that if the company of petitioner is closed, the families of the employees would be put to starvation.

4. Learned counsel for the respondent submits that he has no objection for opening the factory subject to petitioner's providing space for keeping the material under lock and key.

5. Having regard to the facts and circumstances of the case and in view of the judgment of this Court in Crl.P.No.7798 of 2010, the petitioner is permitted to open the factory on the following terms and conditions:

i) The petitioner shall execute a personal bond for Rs.2 1⁄2 lakhs with two sureties for the like sum to the satisfaction of Metropolitan Sessions Judge, Cyberabad. ii) The petitioner shall provide space for keeping the material found in the premises on 6th and 7th July, 2014 in a separate room under lock and key and the officers shall take the samples in the presence of panch witnesses.

iii) The officials shall be permitted to visit and check the material kept in a separate room between 9 am and 6 pm on every day.

However, It is made clear that the petitioner shall not use the premises for doing any illegal act.

With the above directions, the Criminal Revision Case is disposed of. As a sequel thereto, Miscellaneous Petitions pending if any in this Criminal Revision, shall stand closed. ____________________ C. PRAVEEN KUMAR, J 12-03-2015 nvl
