HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.13951 of 2016 ORDER :

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioners - A.1 to A.4, seeking to direct the learned II Additional District and Sessions Judge, Amalapuram, East Godavari District, to expedite hearing of Criminal Appeal No.171 of 2016 pending on its file. 2.

Heard learned counsel for the petitioners as well as the learned Public Prosecutor and perused the material on record.

Learned counsel for the petitioners would submit that though, there has been clean acquittal of the petitioners, vide judgment dated 17.02.2016, passed in S.C.No.122 of 2012 by the Assistant Sessions Judge, Razole, for the offences punishable under Sections 307, 376 r/w. Sections 511, 448, 506 r/w. Section 34 of IPC, the prosecution preferred the aforesaid appeal and the same is not being disposed of expeditiously and hence, sought for expedite hearing of the appeal.

The above Criminal Appeal relates to the year 2016, the current year. Unless the relevant data is available as to how many criminal appeals and other matters are pending on the

ASN,J Crl.P.No.13951 of 2016 file of II Additional District and Sessions Judge, Amalapuram, East Godavari District, it is difficult to give priority to Crl.A.No.171 of 2016 and direct the learned Sessions Judge to dispose of the same.

Therefore, there is no merit in the present Criminal Petition and the same is dismissed. However, the presence of the 1st petitioner - Nagireddy Venkateswara Rao (A.1) is dispensed with during the pendency of Criminal Appeal, subject to the condition that he shall appear as and when directed by the learned Sessions Judge.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
