Heard Smt.G.Padmavathi for petitioner and the Assistant Government Pleader for Home.
The petitioner prays for Mandamus declaring the highhanded action of respondents in trying to dispossess the petitioners from their ancestral house and vacant site covered by Assessment No.36 of Uddandapuram Gram Panchayat, Uddandapuram Village, Nakkapalli Mandal, Visakhapatnam District, without recourse to law as illegal and unconstitutional.
On 24-06-2009 this court directed the parties to maintain statusquo as on that date until further orders. The interim order is subsisting as on date. The respondents have not filed counter affidavit opposing the prayer.
I have perused the annexures filed alongwith writ affidavit. Prima facie, I am satisfied that the petitioner is in occupation of a small plot of land i.e., petition land. Therefore, the respondents are directed not to dispossess the petitioner from petition land except in accordance with law and after affording opportunity of hearing.
