THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1846 of 2013 ORDER:
The order, violation of which is alleged in this contempt case, is the order passed by this Court in W.P.No.35791 of 2012 dated 03.12.2012 recording the submission made in the counter affidavit that the police officials are not interfering with the civil disputes between the petitioners and respondents 3 and 4. On the ground that the petitioners have been called to the police station, despite the undertaking given to this Court, the present contempt case is filed.
In the additional counter affidavit filed by the respondent, it is stated that the case in Crime No.221 of 2013 was registered on 06.12.2013 under Section 420 I.P.C by the Station House Officer, who worked for one month from 23.11.2013 to 23.12.2013; thereafter the present SubInspector of Police took charge of the office of S.H.O on 23.12.2013, and verified the entire records; on coming to know that the matter is civil in nature, he concluded investigation and filed a final report on 23.01.2014 referring to the case as "civil in nature"; and he never interfered with the civil disputes as alleged by the petitioners. No reply affidavit is filed to the specific averments in the additional counter affidavit.
As the Crime registered, by the erstwhile Station House Officer, has since been investigated and a final report was submitted to the Court stating that the dispute is "civil in nature", I see no reason to take action against the respondent under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed.
