HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9196 of 2018 O R D E R :

It is the case of the petitioner that he was engaged as NMR on 01-12-1986. Earlier, the petitioner filed O.A.No.3149 of 2004 seeking regularization and the Andhra Pradesh Administrative Tribunal by its order 24-06-2009 disposed of the said O.A. directing the respondents therein to pass appropriate orders in accordance with Rules on the representation made by the petitioner regarding fixation of his seniority above the 4th respondent therein and regularization of his services as per G.O.Ms.No.212, Finance & Planning Department, dated 22-04-1994. When there was surplus manpower, the petitioner and 17 others were surrendered to the Tribal Welfare Department as they found eligible as per G.O.Ms.No.212, dated 22-04-1994 and the petitioner's name stood at Sl.No.12 in the said list vide proceedings dated 26-03-2011.

The 3rd respondent vide memo dated 09-11-2017 has also forwarded the proposal proforma. By proceedings dated 27-12-2011, the petitioner was given full additional charge of Assistant Engineer, Palvancha, Sub-division. Vide letter dated 17-12-2009 addressed by the 5th respondent to the 4th respondent for regularization of services of the petitioner. Aggrieved by inaction of the respondents, the present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services.

Since the petitioner is working from 1986 and on more than one occasion, the petitioner's case was recommended for regularization and sent proposals, it is for the competent authority to take decision on the said proposals in accordance with law.

In view of the same, the writ petition is disposed of directing the competent authority to consider the proposals dated 17-12-2009 sent by the 5th respondent and take action in accordance with law. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
