ORAL ORDER:

Petitioner alleges that he is owner of open plot with boundary wall bearing No. 13, Survey No. 157 to 162, 175, 176 and 177/A, admeasuring 593 sq yards, Suraram village, Quthubullahpur mandal, Ranga Reddy district having purchased the same from Sri S Chandra Shekar through registered sale deed dated 13.5.2019. 2.

This writ petition is filed alleging that unofficial respondent has made illegal construction of compound wall over the subject property and in spite of the representations made to GHMC for removal of unauthorized construction, no action is taken. 3.

Material on record, would disclose that petitioner purchased the property vide document dated 13.5.2019 whereas he claims to have made representation to the Commissioner of GHMC on 23.4.2019 regarding alleged illegal construction of compound wall. Material on record would also disclose that Bhagya Nagar Cooperative Credit Society Limited represented by its authorized person Sri K Ram Mohan Reddy/petitioner herein and his vendor Sri S Chandra Shekar instituted suit in O S No. 107 of 2019 on the file of the Senior Civil Judge, Ranga Reddy district at Medchal wherein in by order dated 13.3.2019, in I A No. 379 of 2019, the trial Court granted exparte ad-interim temporary injunction and adjourned the matter to 17.4.2019.

No document filed as to what transpired on 17.4.2019. The defendants in the suit are not made parties herein. It is not stated as to how 5th

respondent herein has undertaken construction of the compound wall and how he is related to the defendants in the pending suit. Since the suit is already instituted in the name of Bhagyanagar Cooperative Credit Society Limited represented by petitioner herein and his vendor Sri S Chandra Shekar, the Court is not inclined to entertain this writ petition and grant the relief as prayed for. Accordingly, the writ petition is dismissed. However, it is always open to the petitioners to take appropriate steps in the pending suit. No costs.
