THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 40240 of 2012 and Contempt Case No.982 of 2013 Common Order:

The Writ Petition was filed challenging the proceedings dated 19.12.2010 placing the petitioner temporarily out of contract employment and this Court, by an order dated 02.01.2013, declined to grant any suspension of the said order, but however, directed the payment of subsistence allowance.

W.V.M.P.No.333 of 2014 was filed seeking vacation of the said order and Contempt Case No.982 of 2013 was filed alleging nonimplementation of the said order. When the Contempt Case was taken up earlier for consideration, it was stated that even before passing the impugned order of suspension dated 19.12.2010 the petitioner was posted to Integrated Water Management Programme (IWMP) Kanchili Mandal, Sompeta Cluster on 28.10.2010 and he joined there on 01.12.2010. Thereafter, the petitioner took up employment in Bapuji Rural Enlightenment and Development Society (BPEDS). Later on, an order of termination was passed on 24.01.2013. When the said statement was made, learned counsel for the petitioner took time to get instructions with regard to the said events and today when the above cases are listed learned counsel for the petitioner sought permission of this Court to challenge the order of termination dated 24.01.2013 in appropriate proceedings.

In view of the above circumstances, nothing survives in the Writ Petition as well as in the Contempt Case and, accordingly, both the Writ Petition and the Contempt Case are closed giving liberty to the petitioner to take appropriate proceedings in accordance with law. There shall be no order as to costs. The Miscellaneous Petitions pending, if any, shall stand closed.
