THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5290 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/ accused in C.C.No.178 of 2015 pending on the file of IV Additional Judicial Magistrate of First Class, Kakinada, East Godavari District, arising out of private complaint for the offences punishable under Sections 120-B, 379, 420, 440, 447, 468, 506 (2) read with Section 34 IPC.

Heard the learned counsel for the petitioners/accused and the learned Public Prosecutor and perused the material available on record.

After arguing for some time, the learned counsel for the petitioners confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court. Having regard to the facts and circumstances of the case and in view of the submission made by the learned counsel for the petitioners, the presence of the petitioners/accused is dispensed with except on the dates when their presence is specifically required for the purpose of framing of charges, examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment. However, the petitioners/accused shall be properly represented by their counsel.

Accordingly, the criminal petition is disposed of.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
