THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6029 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.2 seeking grant of bail in crime No.83 of 2014 on the file of the Pedavegi P.S., West Godavari District, registered for the offences under Sections 302 and 307 read with Section 34 IPC.

Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioner has been in judicial custody since 06.05.2014 and that he has been falsely implicated in the case. He further submits that most part of the investigation is completed and the charge sheet is also filed and as such, he prays to grant bail to the petitioner/A.2.

Learned Additional Public Prosecutor submits that the petitioner/A.2 is a contract killer and he is directly involved in the commission of crime. He further submits that the petitioner is also involved in another crime registered for the offence under Section 302 IPC. Learned counsel for the petitioner submits that even though another case is registered against the petitioner/A.2, he has been regularly attending the Court without fail and as such, there is no possibility of the petitioner escaping from the hands of justice. It is evident from the record that the petitioner, after grant of bail in another case, which is registered for the similar offence, has committed the present crime and as such, the petitioner/A.2 is not entitled for bail. The criminal petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 21.07.2015 pln
