THE HONOURBLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 4943 of 2025 ORDER:

This Criminal Petition is filed under Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) by the petitioner/accused No.3 seeking modification of the bail condition by reducing the surety amount imposed by this Court in Criminal Petition No.4377 of 2025 on 03.04.2025.

Heard Mr. M. Mahesh, learned counsel representing Mrs. B. Rajani, learned counsel for the petitioner, and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner approached this Court and filed Criminal Petition No.4377 of 2025. This Court while allowing the above said criminal petition on 03.04.2025 directed the petitioner to execute a personal bond for a sum of Rs.50,000/- with two sureties for a like sum each to the satisfaction of the XII Additional Chief Judicial Magistrate at Nampally and imposed other conditions also. Due to financial difficulties, the petitioner could not submit sureties as directed by this Court. Unless the amount is reduced from Rs.50,000/- to Rs.25,000/-, the petitioner will be put to irreparable loss and great hardship.

Learned Additional Public Prosecutor has not opposed the same.

Taking into consideration the facts and circumstances of the case and in view of the submissions made by the learned counsel for the petitioner, this Court deems it appropriate to modify the condition No.7(i) that "The petitioner/accused No.3 shall be enlarged on bail on executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the XII Additional Chief Judicial Magistrate at Nampally". The other conditions remain unaltered except above.

With the above modification, the Criminal Petition is disposed of.

Miscellaneous applications, pending if any, shall stand closed.
