HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION NO. 1381 OF 2015 ORDER:

After hearing both sides at the admission stage, the following order is passed.

On the report of the de-facto complainant, the police of Rajahmundry II Town Police Station, East Godavari District, registered FIR No. 355 of 2014 against petitioners/A2 & A3 for the offences under Sections 417, 493 & 376 IPC read with Sections 3 & 4 of Dowry Prohibition Act and Section 3(1)(x) & 3(2(v) of SC & ST (POA) Act, 1989. The allegations are that A1 on the pretext of loving and marrying the de-facto complainant had sexual intercourse with her and later cheated her and whereas, petitioners/A2 and A3 are concerned, they are brothers of A1 and when the de-facto complainant and her people contacted A2 and A3 for the marriage of A1 and de-facto complainant, they abused the complainant by her caste. Investigation is reported to be pending.

Having regard to the prima facie accusation contained in the FIR and as the investigation is reported to be pending, it is not a fit case to quash the proceedings. Therefore, investigation shall continue to its logical end. However, considering the request of the learned counsel for the petitioners to the effect that the petitioners are aged parents and their arrest will cause any amount of hardship to them, the Police of Rajahmundry II Town Police Station, East Godavari District, are directed not to arrest petitioners/A2 & A3 during the course of investigation. The petitioners shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, the Criminal Petition is disposed of.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
