HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.9390 OF 2018 ORDER:
This writ petition is filed challenging the proceedings No.108/HRM(G)FA/2015, dated 18.02.2017, issued by the 2nd respondent, whereby petitioner's services as Field Assistant of Medapalli Gram Panchayat of Nallabelli Mandal, Warangal District, were terminated.
Learned counsel for the petitioner submits that the impugned proceedings were issued without conducting any enquiry and without affording the petitioner reasonable opportunity of being heard.
Heard Smt.R.Padma Rekha, learned counsel for respondents 2 and 3.
A reading of the impugned order goes to show that no notice was issued to the petitioner and no enquiry has been conducted. It only reads that disciplinary proceedings are contemplated against the delinquent employee and in the same proceedings petitioner's services were terminated on certain allegations which are as follows;
1. Not opening of works for providing wage employment to the poor labourers.
2. Unauthorized absence from duty.
3. Demand not capture through the mobile.
4. Not achieved the target in all aspects of EGS.
Having regard to the facts and circumstances, the impugned order dated 18.02.2017 issud by the 2nd respondent is set aside only on the ground of principles of natural justice. However, this order will not preclude the respondents from taking action against the petitioner, in accordance with law. Accordingly, the writ petition is allowed. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 03.04.2018 tk
