HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37083 of 2016 ORDER:

The present writ petition is filed by the petitioner invoking Article 226 of the Constitution of India seeking to declare the inaction of the 2nd respondent in considering the representation of the petitioner made on 15.06.2015 as illegal and arbitrary. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. With their consent, the writ petition is disposed of at the admission stage itself. There is no necessity to put respondents 6 to 9 on notice since this Court is not venturing to adjudicate the case on merits. Learned counsel for the petitioner mainly submits that though the petitioner made a representation on 15.06.2016 to the 2nd respondent to take action against R-6, till date no steps are taken.

A perusal of the representation dated 15.06.2015 would show that the same was made seeking correction of entries in the revenue records. The contents of the representation, which is sought to be disposed of, and the contents of the prayer sought for in the writ petition are totally different. Hence, I see no merits in the writ petition. However, the petitioner is always at liberty to take appropriate steps, in accordance with law, for cancellation of entries made in the revenue records.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE C. PRAVEEN KUMAR 31.10.2016 sur
