THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30072 of 2015 ORDER:

The petitioner is working as School Assistant in the Government High School, Darsi. He was appointed as a District Coordinator in the A.P. Open School Society in the office of the District Educational Officer, Prakasam by proceedings dated 28.06.2012. He was posted in place of one D.J.Jerimiah and the said Jerimiah filed O.A.No.5265 of 2012 challenging the proceedings dated 28.06.2012. The said O.A. was disposed of on 17.08.2012 on his withdrawal. The petitioner took charge as District Coordinator on 21.09.2012. When one A.V.Prathap was recommended for appointment as District Coordinator by the Hon'ble Minister for H.R.D, the present writ petition was filed challenging the Memo dated 28.11.2014 issued by the Principal Secretary to Government (SE) to the State Project Director, Sarva Shiksha Abhiyan, Andhra Pradesh, Hyderabad enclosing the note of the Hon'ble Minister.

This Court by order dated 06.10.2015 ordered status quo. Seeking vacation of the said order, W.V.M.P.No.2748 of 2016 and W.V.M.P.No.2816 of 2016 were filed by respondents 5 and 6 respectively.

It is the case of petitioner that the post of District Coordinator shall be filled by following the G.O.Rt.No.1214, Education (Prog.II.I) Department, dated 12.08.1987 and the learned counsel for vacate petitioners submits that apart from the

School Assistants working in Government schools, those working in other schools run by the local bodies were also considered as per the instructions of Director, A.P. Open School Society, Hyderabad dated 21.10.2009.

Now, there is no dispute that the petitioner, who is working as School Assistant and sent on deputation as District Coordinator, had completed his tenure. It is for the respondents 2 and 3 to implement the Government orders and appoint suitable persons as District Coordinators. In view of the completion of tenure of the petitioner, this Court is not inclined to examine the rival claims of petitioner and respondents 5 and 6 and it is left open to respondents 2 and 3 to take appropriate action in accordance with law for filling up the posts of District Coordinator in the Office of the District Educational Officer, Prakasam for working with the A.P. Open School Society.

With the above observations, this Writ Petition is closed. No order as to costs.
