THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.27628 of 2008 ORDER:

In this Writ Petition, petitioners question the permission granted in favour of respondent No.5 for construction of commercial building in the premises bearing No.8-2-644/1 situated at the junction of road Nos.1 and 12, Banjara Hills, Hyderabad.

For the purpose of disposal of this Writ Petition, it is not necessary to mention in detail the facts of the case as admittedly, during pendency of the proceedings before this Court, the petitioners filed O.S.Nos.224 of 2008 and 282 of 2013 in the Court of XXV Additional Chief Judge, City Civil Court, Hyderabad, against respondent No.5 and the said suits are pending.

At the hearing, it is submitted by the learned counsel for both the parties that the petitioners entered a memorandum of understanding dated 07.01.2009 with respondent No.5, who is alleged to have acquired rights in the property on account of GPA dated 18.08.2007 executed by respondents 6 to 15; that non-performance of the said memorandum of understanding is

CKR, J WP.No.27628 of 2008 the subject matter of O.S.No.282 of 2013 and that the trial in the said civil suits has concluded and the matters are reserved for orders since 29.01.2018 and thereby, prayed that this Writ Petition may be closed by giving liberty to the parties to workout their remedies in accordance with law, subject to the outcome of the aforesaid civil suits.

Recording the above said submissions, this Writ Petition is closed leaving it open to the parties to workout their remedies in accordance with law, subject to the outcome of the aforesaid civil suits.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
