THE HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.3989 OF 2015 ORDER:

This revision petition, under Article 227 of the Constitution of India, is filed by the defendant in O.S.No.538 of 2011 on the file of III Senior Civil Judge, City Civil Court, Secundrabad, aggrieved by the order, dated 18.08.2015, passed in I.A.No.73 of 2015 in the said Suit. Respondent - plaintiff filed the aforesaid Suit for ejectment, arrears of rent, mesne profits and costs. In the said Suit, petitioner - defendant filed the present I.A. to direct the respondent to produce the Books of Account Register and Rental Receipts Books for the years 2012 to 2014, only on the ground that the respondent, who was examined as PW.1, has admitted in his cross examination that the other tenants are paying enhanced rents. The Court below, by impugned order, dated 18.08.2015, has dismissed such application. Heard learned counsel for the petitioner.

Having regard to the nature of the Suit, it is not necessary to verify whether the other tenants in the same block are paying enhanced rents or not. Further, it is clear that in order to protract the litigation, the petitioner has filed the present application. Hence, I do not find any merit in this revision petition, so as to interfere with the impugned order.

Accordingly, the revision petition is dismissed. Miscellaneous Petitions, if any, pending in this revision petition, shall stand closed. No costs.
