THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2897 of 2015 ORDER:

The writ petitioners question the legality of e x parte interim orders dated 13.11.2014 passed by the 1st respondent in an interlocutory application filed under Order XXXIX Rule 1 r/w Section 151 of the Code of Civil Procedure, in a Civil Suit in A4/CPC/301/2014.

2. The 1st respondent-Additional Agent, in exercise of powers under Section 42 of the A.P. Agency Rules, granted the impugned ex parte interim order, and the petitioners herein have a right to move the designated authority seeking vacation or modification of the interim orders which are questioned now. Further, the petitioners counsel also submits that the petitioners have filed a petition on 07.01.2015 seeking vacation of the ex parte interim orders.

3. Inasmuch as the petitioners have availed the remedy available under the Agency Rules, no orders are necessary in this writ petition.

4. Accordingly, the writ petition is closed; however, with a direction to the 1st respondent to consider the vacate petition said to have been filed by the petitioners on 07.01.2015 and pass appropriate orders thereon, in accordance with law, preferably within six weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
