HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3455 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioner/accused seeking to quash the proceedings against him in P.R.C.No. 27 of 2017 (FIR No. 288 of 2017 of Jangaon Police Station, Jangaon) registered for the offences under Sections 307, 452, 427 and 506 IPC.

Learned counsel for the petitioner would strenuously argue that the complaint was a false one and even if the injuries as mentioned in the medical certificate are taken into consideration, there is no scope for charge under Section 307 IPC. Learned counsel also questions the bonafides of the medical certificate. On this argument, he sought for quashment of proceedings.

It is seen that in this case, charge sheet is filed and PRC is registered and the matter is at the stage of committal.

In that view of the matter, it is not a fit case to quash the proceedings. However, the petitioner/accused is granted liberty to seek for discharge by filing an appropriate application before the concerned Court, in which case, the trial Court shall consider the application and pass orders on merits. Accordingly, the Criminal Petition is disposed of.
