Heard learned counsel for the petitioners.
This civil revision petition is directed against the action of the Senior Civil Judge, Nalgonda in not passing any orders in E.P.No.115 of 2013 in O.S.No.110 of 1983.
This Court after hearing the submissions of learned counsel for the petitioners that the lower Court is adjourning the matter from time to time, at the instance of the defendants without passing any orders, called for a copy of the docket proceedings, by order dated 13.03.2015. Pursuant to the communication from the Registry on 16.03.2015, the learned Senior Civil Judge, Nalgonda sent a copy of the order in E.P.No.115 of 2013.
A perusal of the docket proceedings from 19.09.2013 to the date of the order of this Court clearly shows that the case was adjourned solely on the ground that no counter was filed and ultimately an order was passed on 23.03.2015 for issuing warrant of delivery of possession for evicting JDrs 1 and 2 from the E.P. schedule property by 13.04.2015. In view of the same, the learned counsel for the petitioners submitted that no further orders are necessary in this case.
Recording the said submission, the civil revision petition is accordingly dismissed as infructuous. There shall be no order as to costs. Pending miscellaneous petitions in this revision petition, if any, shall stand dismissed in consequence.
