THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.25101 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition is filed against the order dated 29.01.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.238 of 2016. This order reads as under: "Admit: Notice to the respondents returnable in six weeks." We are of the opinion that no writ petition would lie against an order passed by the Tribunal admitting an O.A. and directing notice to the respondents therein. Unless the matter is adjudicated by the Tribunal in the first instance, be it at the final or at the interlocutory stage, recourse cannot be taken to the writ jurisdiction of this Court in terms of the law laid down by the Supreme Court in L. Chandra Kumar v. Union of India[1].

The writ petition is utterly misconceived and is accordingly dismissed. It is open to the writ petitioner/applicant to move the Tribunal for interim relief in the pending O.A. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
