Akula Mondaiah [Died] v. Jangili Rajeshwar Rao
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Civil Revision Petition No.170 of 2016 ORDER :
This Civil Revision Petition is filed against the order dated 11.12.2015 in IA No.136 of 2012 in O.S.No.197 of 2007 wherein the Court below condoned the delay in bringing legal representatives of the first defendant on record.
Heard learned counsel for the petitioner, who submits that without assigning any reason, the trial Court passed orders condoning the delay, which is erroneous.
A perusal of the impugned order dated 11.12.2015 goes to show that delay was condoned on payment of costs of Rs.200/- by exercising discretion, that too, for bringing the legal representatives of the first defendant on record.
Hence, I do not see any reason to interfere with the impugned order passed by the trial Court on 11.12.2015 in I.A.No.136 of 2012 in O.S.No.197 of 2007, which is passed exercising the discretion. Accordingly this Civil Revision Petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, shall stands closed.
