THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT W.P.No.27022 OF 2016 ORDER:

Vide present writ petition, petitioners seek direction thereby declaring the action of the respondents in issuing Form 7 notice under Section 21(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act') on 04.06.2016 proposing to acquire the lands for the public purpose by fixing compensation to the petitioners, who are owners of the land in Gottimukkaoa Village, without following the mandatory provisions of the Act, as illegal, arbitrary and discriminative. Heard learned counsel for both parties and perused the material placed on record.

Learned counsel appearing on behalf of the petitioners submitted that for the relief sought in the writ petition, the petitioners made representation to the Minister for Irrigation, Mines and Geology, Marketing and Legislative Affairs. However, till date no decision has been taken.

Keeping in view the averments made in the writ petition and the submission of learned counsel for the parties, this writ petition is disposed of directing the concerned authority to take decision on the representation made by the petitioners and pass appropriate orders, in accordance with law, within four weeks from the date of receipt of a copy of this order. No order as to costs.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
