THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.421 of 2015 in Crl.P.No.12156 of 2014 and Crl.P.No.12156 of 2014 Common Order:

The de-facto complainant and his counsel Sri M.Aravind are present. Accused and their counsel Sri C.Vikram Chandra are present.

Heard both sides.

2) On the report filed by de-facto complainant the police of KPHB PS registered FIR No.170 of 2014 against the accused and investigated the matter and filed charge sheet under Sections 342, 323, 506, 290 and 307 IPC and Section 4(i) and (iii) of Andhra Pradesh Prohibition of Ragging Act, 1997 on the allegation that the accused who are B.Tech. students committed the act of ragging against the de-facto complainant and in that process they made him to sit on his knees for one hour in spite of his request that he was suffering from Asthama and Suffocation and they beat him on his chest and caused much harassment to him.

3) Now, both the parties submitted that at the intervention of elders, they have resolved their differences and they are now peacefully studying without involving in any ragging activities and hence considering their future, they may be permitted to compound offence and proceedings may be quashed in the interest of justice.

4) Considering the fact that offences alleged against the accused are not grave ones and they were committed by the students in a playful youth mind without any criminal intention and also considering their future this Court already accorded permission to compromise the matter as per order dated 02.02.2015 in Crl.P.M.P.No.420 of 2015.

5) Pursuant to above permission and following the decision reported in Gian Singh v. State of Punjab and another[1] this petition is allowed and compromise is recorded in terms of Memorandum of Compromise and consequently the proceedings in FIR No.170 of 2014 of KPHB PS are hereby quashed.

6) In the result, both the petitions are accordingly allowed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
