This writ petition is filed challenging the action of respondents 1 to 3 in finalizing the Mission Kakatiya-II work to be taken up in the writ petitioners' patta lands in Sy.No.125 to 127 of Indhanpally Village, jannram Mandal, Adilabad District in the guise of restoration of nonexisting "Thalla Cheruvu" without following due process of law. The grievance of the petitioners is that their possession and enjoyment of the land in Sy.Nos.125 to 127, totaling to Ac.11.12 gts situated in Indhanpally Village, Jannram Mandal, Adilabad District, is sought to be interfered with by the respondents under the guise of 'Mission Kakatiya Project' without issuing any notice, without acquiring their land and without paying any compensation to them. Learned counsel for the petitioner places reliance on the order dated 08.02.2016 passed by this Court in W.P.M.P.No.4780 of 2016 in W.P.No.3741 of 2016.
Learned Government Pleader for Respondents, on instructions, submits that the tenders have already been finalized by awarding works to the 4th respondent.
In that view of the matter, I deem it appropriate to direct the respondents not to undertake any works in Sy.Nos.125 to 127 of Indhanpally Village, without putting the petitioners on notice and without acquiring their land by paying due compensation to them. With the above direction the writ petition is disposed of. As a sequel, Miscellaneous Petitions pending, if any, shall stand closed. No order as to costs.
