THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CONTEMPT CASE No.1887 of 2015 ORDER:

This contempt case is initiated on the premises that the order passed by this Court in W.P.M.P.No.23805 of 2013 in W.P.No.19453 of 2013 on 18.07.2013 has not been complied with by the respondent-university. Sri Deepak Bhattacharjee, learned counsel for the respondent-Osmania University, has filed a detailed counter affidavit in the matter sworn by Registrar of the University. In Para 4 of the said affidavit, it is brought out that the petitioner applied for the post of Assistant Professor in History against the one vacancy reserved for BC-E category candidate. Interviews were conducted on 24.01.2013 wherein the petitioner has also attended. It is brought out that another W.P.No.

4723 of 2009 was filed by Academic Consultant in the Department of History and direction was issued to keep one post in the department of history vacant and hence, there is no violation of the orders passed by this Court by the respondent-university. In Para 6 of the affidavit, the entire matter relating to the selections carried by the Committee, the recommendations made by the Committee with regard to BC-E category has not been cleared by the Sub Committee of the Executive council, in view of that fact that the Selection Committee has not made any recommendations to be appointed as such.

In view of the contents of the counter affidavit, leaving it open to the petitioner to work out his remedies in the writ petition, this contempt case is dismissed. Consequently, miscellaneous petitions, pending in this petition, shall also stand dismissed. No costs.
