HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9251 OF 2018 O R D E R :

This writ petition is filed challenging the proceedings vide Memo No.E2/3126/APEWIDC/2013, dated 05.03.2018, issued by the 2nd respondent, wherein objections were called for, communicating the provisional seniority list of Deputy Executive Engineers working on regular basis in 2nd respondent-Corporation. Learned counsel for the petitioners submits that although petitioners submitted representation dated 14.02.2018, the respondents issued impugned proceedings.

On the other hand Sri G.Seena Kumar, learned Senior Counsel for the 2nd respondent submits that the petitioner could have filed objections after impugned proceedings are issued; and that instead of filing objections they have straight away rushed to this Court.

Though learned counsel for the petitioner tried to argue that the seniority of the respondents is wrongly fixed, but, any how opportunity is given by the respondents for filing objections as petitioners fall under category 'c'. In view of the same, it is open for the petitioners to file fresh objections, within a period of two weeks from today and on such objections being filed by the petitioners, the 2nd respondent shall consider the same in accordance with Rules and take action.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
