THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.3749 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for the respondents. The petitioner complains of inaction on the part of the respondents in registering a case against the accused in spite of filing three complaints, dated 17.12.2014, 04.02.2015 and 12.02.2015. The petitioner also filed copies of the said complaints, which show that they were addressed to Circle Inspector of Police and the copies thereof were marked to the Superintendent of Police and Deputy Superintendent of Police, Miryalguda II Town Police Station and acknowledgements, dated 03.01.2015, received are also filed. However, it appears that the petitioner has not filed complaint before the Station House Officer (for short, 'the SHO'), II Town Police Station, Miryalguda, nor the SHO is impleaded in this Writ Petition.
Learned Government Pleader for Home, on instructions from the SHO, states that the SHO has not received any of the complaints as claimed by the petitioner and further if the petitioner approaches the SHO and lodges any complaint, the SHO assures of taking appropriate action.
In view of the said assurance, the petitioner is at liberty to approach the SHO, II Town Police Station, Miryalguda, and file an
appropriate complaint. If any such complaint is filed, the SHO shall take appropriate action thereon expeditiously. The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
