B. Rajasekhar v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8380 OF 2017 ORDER:
Challenging the endorsement of the 2nd respondent in B.30/2017, dated 19.01.2017, this writ petition is filed. When the matter is taken up for hearing, learned Assistant Government Pleader for Revenue submits that there is a remedy of appeal against the impugned endorsement under Section 5(5) of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act'), and hence the petitioner may be directed to avail the said remedy.
Learned counsel or the petitioner does not dispute the availability of remedy of appeal.
Heard Sri S. Arifulla, learned Standing counsel for Wakf Board.
In view of the submissions made, the writ petition is disposed of granting liberty to the petitioner to avail remedy of appeal under Section 5(5) of the Act. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 10.03.2017 dv
