HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.7154 OF 2009 ORDER:

This writ petition is filed by the petitioners seeking a direction to the respondents not to interfere in any manner with the structures raised by them in their site.

On 6.4.2009 while admitting the writ petition, this Court passed interim orders directing both the parties to maintain status quo. Today, when this matter has come up for hearing, the learned Standing Counsel for the 1st respondent submitted that the petitioners have to obtain permission to make any constructions from CRZ-III. 3.
Considering the facts and circumstances of the case and the submissions made by the learned Standing Counsel, without expressing any opinion on merits, the petitioners are directed to submit an application along with a plan before the competent authorities for permission to make any constructions in their site. On such application being filed, the respondents are directed to dispose of the same in accordance with law. Till then, the respondents are directed not to interfere with the constructions made by the petitioners. The petitioners are also directed not to make any further constructions till disposal of their application. 4.
With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
