Mohd. Muneeruddin v. The State Of Telangana
HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.11274 of 2019 ORDER:
The petitioner is aggrieved by the failure on the part of the respondent authorities in undertaking a survey of his land in terms of his representation dated 10.05.2019.
In the light of the order proposed to be passed by this Court, it is not necessary to put respondent Nos.7 to 15 on notice or afford them an opportunity of hearing.
The record reflects that the petitioner paid the requisite fee under treasury challan dated 20.02.2016 and submitted a written representation only on 10.5.2019. The representation was submitted to the office of the District Collector. In terms of the procedure now extant, a person seeking a survey to be undertaken by the revenue authorities must submit an application on-line. Such an application is titled 'F-Line' petition. It is not open to the petitioner to sleep over the matter for three years and now complain of inaction on the part of the revenue authorities. In that view of the matter, the Writ Petition is disposed of permitting the petitioner to submit a fresh application as per the present procedure along with the requisite fee and necessary documents. In the event such an application is made, the concerned authority shall take appropriate action thereon in accordance with law and due procedure expeditiously.
Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 11th June, 2019.
