ORDER

This writ petition was filed challenging the action of respondents 2 and 3 in awarding contract for transportation of essential commodities from Pedda Kotthapalli Mandal Level Stock point to the fair price shops attached to it, in favour of the 4th respondent, as he could not satisfy the terms and conditions of tender notice dated 14.02.2011.

This Court by order dated 13.04.2011, granted interim direction to consider the representation dated 2.4.2011 of the petitioner.

A counter-affidavit is filed stating that though the 4th respondent's tender was accepted, the same was cancelled by the 1st respondent vide letter No.PDS2/MOVT/FG5 (84) Stage.II 2011-12 and the Corporation took a decision to recall the tenders, pursuant to which, the tenders were recalled vide tender notification dated 16.5.2011.

In view of the same, nothing survives for adjudication in this writ petition.

Accordingly, the Writ Petition is dismissed as infructuous. No costs.
