HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11928 OF 2012

O R D E R

This writ petition is filed for a writ of mandamus declaring the action of the 2nd respondent in issuing the alleged demolition notice dated 20.04.2012, as illegal and arbitrary.

Learned counsel for the petitioners submit that the petitioners filed O.S.No.1956 of 2011 on the file of IV Junior Civil Judge, City Civil Court, Hyderabad in respect of the same property. As such, he does not want to press this writ petition so as to enable the petitioners to pursue the said suit. In view of the aforesaid submission, the writ petition is dismissed as withdrawn with a liberty to the petitioners to pursue their remedies in the suit filed in O.S.No.1956 of 2011.

Interim order granted 26.04.2012 shall stand vacated. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
