THE HON'BLE SRI JUSTICE RAJA ELANGO Transfer Criminal Petition No.106 of 2016 ORDER:

This Transfer Criminal Petition is filed under Section 482 Cr.P.C. seeking to transfer M.C.No.10 of 2015 pending on the file of Judicial Magistrate of First Class, Chittoor to any appropriate Court at Chittoor District.

Heard the learned counsel for the petitioner and perused the material.

The perusal of the material on record would reveal that the grounds raised by the petitioner/accused cannot be the grounds for transfer of the case. It is also evident from the order of the Magistrate that the M.C. case is now posted for order. Since the order is posted for orders, the question of appearance before the Court and the apprehension of threat do not arise and hence, the transfer criminal petition is liable to be dismissed. Accordingly, the transfer Criminal Petition is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand closed.
