THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No.3336 OF 2015 ORDER:
The petitioner is a Co-operative Society, which has instituted this writ petition through its Secretary by name G.Venkateswarlu, S/o G.Venkata Swamy, Yemmiganur, Kurnool District. This is one of the most fruitless litigation indulged in by the Secretary of the Society. The Supreme Court of India has already decided in "Thalappalam Ser. Coop.Bank Ltd v. State of Kerala[1]", that the affairs of the Cooperative Society are not amenable to the Right to Information Act. Therefore, if only the petitioner has brought this information to the notice of the Information Commissioner, perhaps, there would not have been any occasion for the Commissioner to insist upon the petitioner to disclose the information called for by a private party. Therefore, preserving liberty to the petitioner to bring it to the notice of the Information Commissioner that the affairs of the society cannot be subjected to scrutiny of the Right to Information Act, this writ petition is disposed of. No order as to costs. All the miscellaneous petitions pending in this writ petition shall stand closed.
