O R D E R

The case of the petitioner is that he was appointed as Badili Coal Filller in the respondent - Company on 20.12.1985 and during the course of service by virtue of promotions, presently working as Haulage Operator - Category - IV. As per his SSC certificate and transfer certificate, his date of birth is 11.02.1965. The company issued order dated 28.02.2014 stating that as per service book, the date of the birth of the petitioner is recorded as 1.11.1958 and thus he will be retired from service with effect from 30.11.2018. For change of his date of birth in the service book, petitioner made a representation dated 28.10.2016 to the 2nd respondent and aggrieved by the inaction in considering the said representation, the present writ petition is filed.

Heard the learned counsel for the petitioner and the Sri J.Srinivasa Rao, learned Standing Counsel for Singareni Collieries Company Limited. As the representation of the petitioner dated 28.10.2016 for correction of his date of birth in service record, is pending with the 2nd respondent, without expressing any opinion on merits, the writ petition is disposed of directing the said authority to consider and dispose of the representation of the petitioner in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
