The grievance of the petitioner in the present writ petition precisely is that without considering the explanation offered by him to the show cause notice, the 3rd respondent passed the impugned order.
It is submitted by the learned Government Pleader that the petitioner herein did not submit any explanation and the same would be evident from the explanation offered by him on 08-01-2018 wherein he referred to the impugned order. It is further submitted by the learned Government Pleader that the order impugned is appealable under Rule 42(2) of the Rues notified vide G.O.Ms.30, PR, RD&R, dated.20-01-1995.
In view of the said alternative remedy and having regard to the facts and circumstances of the case, this court is not inclined to go into the merits of the case. However, it is open for the petitioner herein to avail the said alternative remedy of appeal under the above said provision of law within a period of three (3) weeks from today, and if any such appeal is filed, the same be considered and pass appropriate orders thereon as expeditiously as possible preferably within a period of four (4) weeks thereafter.
