THE HONOURABLE SRI JUSTICE K. LAKSHMAN I.A. Nos.1 and 2 of 2021 in Crl.P. No.3540 of 2020 AND CRIMINAL PETITION No.3540 OF 2020 ORDER:

This Criminal Petition is filed by the petitioner - accused to quash the proceedings against them in Crime No.463 of 2020 pending on the file of the Bachupally Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are under Sections 468, 467, 471, 406 and 420 read with 120b IPC.

2. During pendency of the present criminal petition, the 2nd respondent - de facto complainant has filed I.A. Nos.1 and 2 of 2021 seeking permission to compromise the matter with the petitioner-Accused to quash the proceedings against the petitioner in the above case by recording the compromise, since they have settled the matter out of Court.

3. Vide order dated 03.02.2021 in Crl.P. No.3540 of 2020, this Court, after recording the submissions made by the learned counsel for the petitioner as well as the 2nd respondent, directed the petitioner and the 2nd respondent to appear before the Registrar (Judicial-I) of this Court, for their identification and also directed the Registrar (Judicial-I) to submit a report to that effect by 12.02.2021. Pursuant to the said order, the Registrar (Judicial-I) of this Court has submitted his report dated 10.02.2021.

In the report dated 10.02.2021 of the Registrar (Judicial-I), it is stated that on oral examination, the 2nd respondent - de facto complainant has stated that he had filed a complaint against the petitioner - accused which was registered as Crime No.463 of 2020 pending on the file of the Bachupally Police Station, Cyberabad Commissionerate for the offences under Sections 468, 467, 471, 406 and 420 read with 120b IPC and that now he has approached this Court for recording the compromise between him and the petitioner. The said report of the Registrar (Judicial-I) of this Court, dated 10.02.2021, is placed on record.

5. In view the said report and also in view of the compromise entered between the 2nd respondent and the petitioner, I.A. Nos.1 and 2 of 2021 are allowed. Consequently, the Criminal Petition No.3540 of 2020 is allowed and the proceedings against the petitioner-Accused in Crime No.463 of 2020 pending on the file of the Bachupally Police Station, Cyberabad Commissionerate, are quashed.
