THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5635 OF 2008 ORDER:

The writ petition is filed questioning the action of the respondents in laying the road in the patta lands belonging to the petitioners in Sy.No.49 etc and Gorja in Sy.No.48 of Gudepu Valasa Village, Bhogapuram Mandal, Vizianagaram District without following the due process.

This Court while ordering notice before admission, gave a direction to the respondent authorities to restrict the car track to an extent of Ac.0.88 cents in Sy.No.48 of Gudepu Valasa Village. There is no counter affidavit filed in the writ petition. In those circumstances the interim order dated 14.03.2008, passed by this Court is made absolute. However, it is made clear that in the event of the land is required for expansion of the road, it is left open for the respondent authorities to initiate appropriate land acquisition proceedings in accordance with the provisions of the Act, 30 of 2013. With the above observations, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition shall also stand dismissed. No order as to costs.
