HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1309 of 2015 O R D E R:

1. The present revision is preferred against the order dated 17.10.2014 passed by the Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.1529 of 2014 in Crl.A.(sr) No.5939 of 2014.

2. The petitioner-accused was convicted and sentenced for the offence under Section 138 of the Negotiable Instruments Act in C.C.No.322 of 2013 by the V Additional Chief Metropolitan Magistrate, Hyderabad. Against the said judgment, the petitioner-accused filed the appeal before the Metropolitan Sessions Judge. As there was delay in filing the appeal, the petitioner also filed an application for condoning the delay in filing the appeal.

On 17.10.2014, the application was dismissed on the ground that there was no representation on behalf of the petitioner. Aggrieved by the same, the petitioner-accused filed the present revision.

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case, this Criminal Revision Case is disposed of with the following direction: "The order under revision is set aside. The learned Metropolitan Sessions Judge, Hyderabad is directed to pass orders afresh in Crl.M.P.No.1529 of 2014 after affording sufficient opportunity to the petitioner." Consequently, the miscellaneous petitions pending, if any, shall stand closed.
