THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.15277 of 2014 ORDER:

There is no representation on behalf of the petitioners. 2.

The prayer sought in the writ petition is as under:- "... to issue any writ or order direction more particularly one in the nature of writ of mandamus declaring the action of the respondents 2 and 3 in interfering with the civil matter and summoning the petitioners to the police station without there being any crime registered against the petitioners as illegal, arbitrary and contrary to the fundamental principles enshrined in the Constitution of India and consequently direct the 3rd respondent not to summon the petitioners without there being a crime registered against them and specifically direct them not to interfere in civil matter and to pass other order and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Government Pleader placed on record the written instructions, dated 10.06.2014, issued by the Sub-Inspector of Police, Kakatiya University Police Station, Warangal District.. 4.

From a perusal of the said written instructions, it is revealed that no complaint of whatsoever is received or registered against the petitioners on the file of the Kakatiya University Police Station, Warangal District. In the absence of registration of any crime against the petitioners, summoning of the petitioners to the Police Station

does not arise. It is further mentioned in the said instructions that there are disputes between the petitioners and the respondents 4 and 5 herein and the matter is purely civil in nature. Therefore, the respondent police have nothing to do with it. The writ petition is filed on mere apprehension to prevent the police from taking any action in the event of lodging any complaint against the petitioners. The present writ petition is filed with baseless allegations. The petitioners are not required in any cases registered on the file of the Kakatiya University Police Station and the respondent police never summoned the petitioners nor interfered with the civil disputes between the petitioners and the respondents 4 and 5.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
