THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 13912 of 2015 ORDER:

The grievance of the petitioner in instituting this writ petition is that the application submitted by him on 13.08.2014 for grant of permission for change of land use from industrial to commercial in an extent of Acs.6.53 cents in Survey Nos.221, 220/3-1A and 220/3-1B situated at Jalaiahnagaram Village, Atmakur Mandal, Nellore District, was returned by the 3rd respondent on the ground that the petitioner has to obtain NOC from the Revenue Divisional Officer-cum-Competent Authority by paying necessary conversion charges, though he paid the requisite fee of Rs.10,000/-.

Learned Government Pleader for Municipal Administration appearing for the respondents 1 to 3 produced a photo copy of letter dated 08.06.2015 addressed by the Regional Deputy Director of Town and Country Planning, Guntur (3rd respondent) to the Municipal Commissioner, Atmakur Municipality (4th respondent) which discloses that the 3rd respondent has approved the application of the 4th respondent dated 17.03.2015 for change of land use from industrial to commercial in an extent of Acs.5.20 cents. A copy of the proceedings dated 08.06.2015 is furnished to the counsel for the petitioner.

In view of the same, the claim of the petitioner that his application dated 13.08.2014 was returned, is not correct. In fact, it was processed and appropriate decision was already taken. If the petitioner is not satisfied by such a decision taken, he is at liberty to work out his remedies available under law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
