ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.184 of 2026 before the Jawaharnagar Police Station, Rachakonda Commissionerate, registered for the offence
punishable under Sections 137(2), 318(2), 64(2)(m), 351(2), 354 of BNS and Sections 5(1) read with 6 of POCSO Act. 2.
The brief facts of the case are that the complainant, mother of the victim, alleged that the accused Jangamayya Goud @ Jagan gained the family's confidence under the guise of spiritual rituals and assistance with dance admissions. He allegedly took the victim to Shirdi in December 2025, where he sexually assaulted her, and thereafter repeatedly committed sexual acts at his residence between January 9 and January 31, 2026. Based on the complaint, FIR No. 184/2026 was registered for the above said offences. 3.
Heard Sri P. Manoj, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated due to financial disputes, specifically a hand loan of Rs.20 lakhs allegedly taken by LW-3. He further submitted that there are contradictions in the complainant's version, including absence
of specific dates and times of the alleged incidents, and evidence that the families were together on tour during the relevant period. He contended that the FIR is fabricated, the petitioner has good antecedents, is a permanent resident with fixed assets, and is willing to furnish sureties and abide by conditions. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition. 5.
Learned Additional Public Prosecutor opposes the bail, submitting that the allegations are grave, involving sexual assault on a minor under the POCSO Act. He further submitted that the victim's statement clearly implicates the accused, and custodial interrogation was necessary to secure evidence. The prosecution emphasizes the seriousness of the offence, the potential threat to witnesses, and the need to ensure justice for the victim. He contended that the dismissal of earlier bail petitions reflects the gravity of the case, and enlargement on bail at this stage may prejudice the ongoing proceedings. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 05.02.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 11 witnesses have been examined.
Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the I Additional District and Sessions Judge, at Kushaiguda.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of
investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
