HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.3472 of 2018 ORDER:
In this petition filed under Section 482 Cr.P.C., petitioners/A2 to A4 seek to quash the proceedings against them in C.C.No.116 of 2018 on the file of VI Additional Junior Civil Judge, Guntur in which petitioners and A1 alleged to have committed the offence under Section 498A IPC and Sections 3 and 4 of Dowry Prohibition Act.
2) It is seen, in this case charge sheet is filed and case is registered and the matter is coming up for framing of charges. Having regard to the said fact, this Court considers, it is not apt to quash the proceedings at this stage. However, the petitioners are at liberty to approach the trial Court and seek for their discharge by way of appropriate petition, in which case the trial Court shall pass an appropriate order on merits.
3) Considering the submission of learned counsel for petitioners that petitioners 1 and 2 i.e. A2 and A3 viz. Ummalaneni Janaki Rama Chandra Rao and Ummalaneni Saroja are the aged persons and petitioner No.3 i.e.A4 is a married sister of A1, the presence of the petitioners/A2 to A4 is dispensed with before the trial Court except on the occasions when the trial Court requires their presence.
4) Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
