THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.41006 OF 2014 ORDER:

The case of the petitioner, as seen from the contents of the affidavit of the petitioner, is that he is the owner of land in survey No.28 of Hothi (K) Village to an extent of Acs.6.00 cents and after paying requisite fee and after complying all necessary formalities, he had been granted permission for conversion of said land from agricultural land into non-agricultural purpose. While so, when the petitioner prepared a plan for applying to the 2nd respondent for making the said land into plots, the 5th respondent, who is the owner of adjacent land in survey No.28, had made illegal lay out of said land without obtaining any approval from concerned authorities and it is the further grievance of the petitioner that the 5th respondent was obstructing the way to his land by constructing a compound wall. Aggrieved over the same, present writ petition is filed.

Heard.

Learned counsel for the 5th respondent, on instructions, submitted that access to petitioner's land will not be obstructed by the 5th respondent and he also conceded for recording the said submission as an undertaking by the 5th respondent. In that view of the matter, the grievance of the petitioner in this writ petition stands redressed. Hence, recording the said submission of the 5th respondent, the present writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
