Toure Lamine v. The State Of Telangana
HON'BLE SRI JUSTI CE CHALLA KODANDA RAM CRI MI NAL PETI TI ON No.2 9 8 4 of 2 0 1 9 ORDER:
This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, seeking grant of bail to the petitioners, who are A2 and A3, in Cr.No.11 of 2019 on the file of the Station House Officer, Cyberabad Crime Police Station, Hyderabad. The offences alleged are under Sections 66 (C), (D) of the Information Technology Act and Sections 419 and 420 of the Indian Penal Code. 2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.
3.
It is a case where two Nigerians were, prima facie, found to be involved in cheating. The material facts, as alleged, disclose an organized crime.
4.
Considering the fact that the petitioners are involved in organized crime and that the visa granted to them also expired, at this point of time, if the petitioners are granted bail, it is very difficult to bring them to book and more so, when the other accused involved in the crimes are absconding, this Court does not find it a fit case to grant bail to the petitioners.
Hence, the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ CHALLA KODANDA RAM June 28, 2019 DSK
