THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.29640 of 2011 ORDER:

The grievance of the petitioner in this case was that the Circle Inspector of Police, Central Crime Station, Hyderabad, the 3rd respondent herein, was not investigating Crime No.891 of 2011 on the file of Banjara Hills Police Station and on the other hand pressuring him to withdraw the complaint lodged by him. He therefore sought a consequential direction to respondent Nos.1 and 2 to transfer the investigation in Crime No.891 of 2011 to the C.B.C.I.D. from the file of the 3rd respondent.

The Assistant Commissioner of Police, Central Crime Station, Detective Department, Hyderabad City, filed a counter-affidavit stating that Crime No.891 of 2011 was registered under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 on the file of Banjara Hills Police Station. The case was subsequently transferred to the Central Crime Station, Hyderabad, as per the orders of the Commissioner of Police, Hyderabad, and was reregistered as Crime No.307 of 2011 on the file of the Central Crime Station, Hyderabad. The Assistant Commissioner of Police, Central Crime Station, Detective Department, Hyderabad, took up investigation in the case and examined various witnesses.

However, when the Assistant Commissioner of Police, Central Crime Station, Hyderabad, issued notices under Sections 160 and 91 Cr.P.C., to the complainant, the petitioner herein, he failed to appear before the said officer and did not furnish his original caste certificate. Ultimately, the Assistant Commissioner of Police, Central Crime Station, Hyderabad, filed a final report before the learned VI Additional Metropolitan Sessions Judge, Hyderabad, referring the case for 'Lack of Evidence'. Notice was served on the complainant to this effect in Form No.

dated 24.04.2012. A copy of the final report dated 30.04.2012 filed under Section 173 Cr.P.C., referring the case for 'Lack of Evidence' and the notice to the complainant in Form No.96 dated 24.04.2012 are placed on record.

In the light of the afore-stated developments, it is for the petitioner to take recourse to appropriate remedies available to him in law, if he is aggrieved by the final conclusion arrived at by the police authorities. The prayer in this writ petition has worked itself out owing to subsequent developments.

The writ petition is accordingly dismissed.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
